Explain to employees why the transfer is necessary. This is very important point, since it is impossible to transfer nurses to cleaners without the consent of the nurses. The Labor Code of the Russian Federation speaks about this (Article 72.1 of the Labor Code of the Russian Federation).

To transfer an employee to another job, sign an additional agreement to the employment contract. In it, reflect all the conditions that you plan to change: new job title, employee responsibilities, new payment conditions. Additional agreement, which was signed by both parties, is an integral part of the employment contract. It is this that confirms the employee’s consent to the transfer. The legislation contains another fallback option for the employer: an employment contract can be terminated if there is a reduction in the number or staff of the organization’s employees (clause 2, part 1, article 81 of the Labor Code of the Russian Federation). That is, an employee can be fired if, even with written consent, it is impossible to transfer him to another job that the employer has. This includes both a vacant position or work that corresponds to the employee’s qualifications, and a vacant lower position or lower-paid work that the employee can perform taking into account his state of health. Due to the fact that this requirement is new and practically no nurse meets these requirements, it is possible, based on the results of certification, not to dismiss nurses due to the employee’s inadequacy for the position held or the work performed due to insufficient qualifications confirmed by the certification results (clause 2, part 1, art. 81 of the Labor Code of the Russian Federation), and offer to take the position of a cleaner.

Let's talk about another method of transferring nurses to cleaners - economic.

It is possible to set a higher salary for cleaners, thereby luring nurses to positions as cleaners. In the future, increase the salaries of cleaners at a slower pace.

However, in this case it will be impossible to force the nurses to do their previous work in full. That is, the problem is that not all the functions of nurses can be assigned to a cleaner.

Nevertheless labor legislation allows you to bring the job responsibilities of a cleaner of industrial premises closer to sanitary ones. An employment contract may contain additional conditions, which do not worsen the employee’s position (Article 57 of the Labor Code of the Russian Federation).

Attention: The labor code established that if work in certain positions is related to the fact that for this the employee is entitled to compensation and benefits, then the names of these positions and qualification requirements for them must correspond to the names and requirements from qualification reference books or professional standards (Part 2 of Article 57 Labor Code of the Russian Federation).

Also, after the transfer, the nurse will lose the right to early assignment of a labor pension, as she will lose the necessary seniority. Nurses belong to the category of workers who are entitled to early retirement (list 2 as amended by Resolution of the USSR Cabinet of Ministers of August 9, 1991 No. 591).

Please note, that there are restrictions on part-time jobs for cleaners. They are subject to Article 284 of the Labor Code of the Russian Federation. That is, they cannot work part-time more than half-time. And part-time work for medical workers is regulated by Resolution of the Ministry of Labor of Russia dated June 30, 2003 No. 41 (hereinafter referred to as Resolution No. 41). Therefore, health workers have the right to work part-time either in another job or in a similar position, specialty, profession (subparagraph “a”, paragraph 1 of Resolution No. 41).

There are also features in determining the maximum duration of part-time working hours. So, to work part-time within a month the full standard of working time, calculated from the established duration working week, employees who belong to junior medical and pharmaceutical personnel can (subparagraph “b”, paragraph 1 of Resolution No. 41). But cleaners are deprived of this opportunity. This can create problems both for the administration of the institution and for the workers themselves, for example, reducing the possibility of part-time work.

The transfer of nurses to cleaners also creates a number of problems with licensing. The procedures for providing medical care provide for the positions of nurses.
